How Much Does a TCPA Violation Cost? Damages Explained
Most compliance risk is abstract until you put a number on it. With the TCPA, the number is very concrete — and it adds up faster than most outbound teams expect, because it's calculated per call, not per lawsuit.
The statutory range
The TCPA allows for statutory damages of $500 per violation, without the plaintiff needing to prove any actual financial harm — annoyance and the unwanted call itself are enough. If the violation is found to be willful or knowing, the court can increase that award up to three times, to $1,500 per violation.
Why "per violation" is the part that surprises people
A violation is typically counted per call (or per text), not per campaign or per lawsuit. That means:
- A single flagged number that gets called repeatedly can generate multiple violations on its own.
- A list with even a small percentage of bad numbers can produce a meaningful count of violations once a full campaign has gone out.
- Class action exposure scales the same way — multiply the per-call number by everyone in the class, and a modest per-violation figure becomes a large aggregate number quickly.
It's not just the damages
Statutory damages are the headline number, but they're rarely the only cost. Legal defense costs, the internal time spent responding to a complaint or investigation, and reputational cost with partners or clients all stack on top. None of that shows up in the $500–$1,500 figure, but all of it is real.
Where the actual risk concentrates
Not every bad number carries equal risk. A number on the National DNC Registry that gets accidentally dialed once is a real violation, but it's a different risk profile than a honeypot number planted specifically to generate a claim, or a number tied to a documented TCPA litigator. The second and third categories are disproportionately likely to actually turn into a claim, which is exactly why scrubbing against them matters as much as scrubbing against the federal DNC list.
The cheapest mitigation available
Against a per-call statutory damages framework, the cost of scrubbing a list before you dial is trivial by comparison — a fraction of a cent per number checked against the hundreds of dollars per violation you're avoiding.
